Notice to Prospective Buyers, Sellers, Landlords, and Tenants

The Texas Real Estate Commission (TREC) regulates real estate brokers and sales agents, real estate inspectors, home warranty companies, easement and right-of-way agents, and timeshare interest providers. TREC is the state agency that licenses and regulates real estate license holders in Texas.

Complaints

If you have a complaint against a real estate broker or sales agent, you may contact TREC. TREC has the authority to investigate complaints and take disciplinary action against license holders who violate the law or TREC rules.

Recovery Trust Account

TREC maintains a Recovery Trust Account to reimburse persons who are damaged by acts of TREC licensees. If you have been damaged by a TREC licensee and are unable to recover your damages through a civil lawsuit, you may be eligible to file a claim with the Recovery Trust Account.

The maximum amount that may be paid from the Recovery Trust Account is $125,000 per transaction, with a maximum of $250,000 per license holder. To be eligible, you must have obtained a final judgment against the license holder and been unable to collect the judgment.

Disciplinary Actions

TREC may suspend or revoke a license, place a license holder on probation, or reprimand a license holder for violations of TREC rules or the Texas Real Estate License Act. TREC may also assess an administrative penalty of up to $5,000 per day per violation.

Unlicensed Activity

It is illegal for a person to broker real estate in Texas without a license. If you suspect someone is engaging in real estate brokerage without a license, you may report it to TREC.
